M87 TERMS OF SERVICE

  1. Introduction

Welcome to M87 (the “Service”), an AI creation and editing platform operated by Cosmic Intelligence, LLC (“we,” “us,” or “our”). M87 enables users to chat with AI and to generate and edit content including text, images, and music. We leverage third-party AI providers (including, by way of example, OpenAI, Google, and Anthropic) to power parts of the Service. By accessing or using M87, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.

  1. Eligibility

You may use M87 only if (a) you are at least 18 years old (or the age of majority in your jurisdiction, if higher) and (b) you have the legal capacity and authority to agree to these Terms. Audio and image generation features are strictly 18+. By using the Service, you represent and warrant that you meet these requirements. We do not actively verify user age and rely on your representation, but we may restrict or suspend access where we reasonably believe otherwise.

  1. Acceptance of Terms

By accessing or using M87, you confirm that you have read, understood, and agree to be bound by these Terms and all applicable laws.

  1. Changes to the Terms

We may modify these Terms at any time. We will post the updated Terms and update the “Last Updated” date. Your continued use of M87 after changes means you accept the revised Terms.

  1. Description of the Service

5.1 Core Functionality

M87 provides AI-powered tools for (i) conversational assistance, (ii) image generation, and (iii) music generation, along with related creation and editing features. M87 is not a substitute for professional advice.

5.2 AI Outputs

Outputs are generated by AI systems and may be inaccurate, incomplete, or offensive/inappropriate. We do not guarantee rights clearance, originality, exclusivity, or uniqueness of any output (including audio loops, stems, lyrics, images, or styles). You are responsible for your use of outputs, including obtaining any necessary permissions and complying with applicable laws.

5.3 Updates and Improvements

We may update, improve, or remove features at any time without obligation to maintain any specific functionality.

  1. Acceptable Use & Prohibited Content

You agree not to use M87 to: • Violate laws or these Terms, or infringe others’ rights (including IP, privacy, or publicity rights). • Generate, upload, or share illegal content; exploitative or non-consensual content; content involving minors (including any sexualized depiction, implied or otherwise); or instructions to commit unlawful acts. • Create content that is defamatory, deceptive, hateful, or threatening, or that incites violence or self-harm. • Collect or harvest personal data about other users without consent. • Transmit viruses, malware, or other malicious code, probe or scan the Service or networks, interfere with security or access controls, abuse rate limits, or reverse engineer the Service. We may filter, block, or remove content and suspend or terminate accounts for violations or suspected violations, and we may preserve or disclose information when legally required.

  1. Privacy

Your use of M87 is subject to our Privacy Policy. We may process prompts, inputs, and outputs (including audio and images), account information, and technical logs to operate, secure, and improve the Service. We use HTTP-only cookies for authentication and session management.

  1. Payments & Refunds

8.1 Payments. If you purchase paid features, payments are processed by Stripe (or its successor) on our behalf; we do not store payment card numbers on our servers. 8.2 No Refunds. All sales are final. We do not offer refunds for subscription fees, one-time purchases, or other charges.

  1. Intellectual Property

9.1 Service Ownership

We and our licensors own the Service and all related materials, excluding User Content and Outputs as defined below.

9.2 User Content License

For content you submit (“User Content”), you grant us a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to host, store, process, display, and use it to operate, secure, and improve the Service.

9.3 Generated Content (“Outputs”) • Ownership & Assignment. As between you and us, you own the Outputs you create using the Service, to the extent permitted by law and applicable third-party provider terms. To the extent we may have any rights in your Outputs, we hereby assign those rights to you; where assignment is not permitted, we grant you an exclusive, perpetual, worldwide, royalty-free license to use them. • Commercial Use. You may use and commercialize your Outputs without paying us, subject to law and these Terms. • No Exclusivity / No Guarantee. We do not guarantee that Outputs are unique, original, or non-infringing, or that they won’t be similar to content generated for others. • Our License to Operate. You grant us a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, process, and transmit your Outputs to operate, secure, and improve the Service (including moderation and abuse prevention). • Your Responsibility. You are responsible for your use of Outputs, including obtaining any permissions or licenses required by law.

9.4 Trademarks

All trademarks, logos, and brand elements used in M87 are the property of their respective owners.

  1. Feature-Specific Terms (Audio & Image Generation) • 18+ Requirement. Access to audio and image generation is restricted to users who are 18+. • Commercial Use Allowed. Subject to these Terms and applicable law, you may use and commercialize audio and image Outputs you create. • Clearances Not Provided. We do not provide rights clearance for voices, likenesses, names, trademarks, samples, brand assets, or other third-party rights. Do not impersonate real people or suggest endorsements without consent; obtain any necessary permissions or licenses. • Style Imitation & Sound-Alikes. Do not use the Service to unlawfully exploit another person’s voice, likeness, or distinctive style, or to create deceptive or misleading content. • Provider / Legal Restrictions. Your use remains subject to any applicable third-party provider terms and to all laws and regulations.

  2. Moderation & Enforcement

We may monitor usage to the extent necessary to operate and secure the Service. We may remove content, rate-limit, or suspend/terminate accounts at our discretion (including to comply with law). We may preserve and disclose information when legally required.

  1. Disclaimers

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, non-infringement, and accuracy. Do not rely on Outputs for professional advice (e.g., legal, medical, financial).

  1. Limitation of Liability

To the maximum extent permitted by law: (a) we are not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, data, or goodwill; and (b) our aggregate liability for all claims in any 12-month period will not exceed the greater of USD $100 or the amounts you paid us in that period.

  1. Indemnification

You agree to defend, indemnify, and hold harmless Cosmic Intelligence, LLC and its affiliates, officers, directors, employees, and agents from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your Outputs or User Content, or your violation of these Terms or law.

  1. Third-Party Services

The Service may integrate with or rely on third-party AI providers and other services (e.g., OpenAI, Google, Anthropic). Your use of such providers may be subject to their terms, and we are not responsible for those services.

  1. Data Storage & Retention

We store account details (e.g., name/username, email, bcrypt-hashed password), session cookies, technical logs (e.g., IP, device/browser), prompts and outputs (including audio files, stems, and images), and related metadata. • Retention. Unless you request deletion or close your account, we may retain such data indefinitely for operation, security, analytics, and improvement. There is no automatic purge schedule currently. • Session Timeout. Session data currently expires after approximately 45 minutes of inactivity (subject to change for security and reliability). • Deletion Requests. Contact root@cosmicai.dev to request account or data deletion; we will handle requests consistent with our Privacy Policy and applicable law.

  1. Rate Limits & Quotas

We may impose or modify quotas, usage caps, and rate limits (e.g., generation units, daily/weekly caps) to ensure Service stability and prevent abuse. We may block requests that exceed limits.

  1. Copyright Complaints

If you believe content on M87 infringes your copyright, email root@cosmicai.dev with: (i) your contact information; (ii) a description of the work claimed to be infringed; (iii) the URL or location of the material; (iv) a statement that you have a good-faith belief the use is not authorized; and (v) a statement made under penalty of perjury that your notice is accurate and you are the owner or authorized to act. We may remove or disable access to contested material at our discretion.

  1. Term & Termination

These Terms apply while you use the Service. You may stop using the Service at any time. We may suspend or terminate access at any time, including for suspected violations. Upon termination, your right to use the Service ends immediately.

  1. Governing Law & Dispute Resolution

These Terms and your use of M87 are governed by the laws of the United States and the state where Cosmic Intelligence, LLC is organized or headquartered (as determined by us), without regard to conflict-of-law rules. Courts in that jurisdiction have exclusive jurisdiction, unless otherwise required by law.

  1. Service Changes

We may modify, suspend, or discontinue the Service (in whole or part) at any time without liability.

  1. General

Severability. If any provision is unenforceable, the remainder will remain in effect. No Waiver. Our failure to enforce a provision is not a waiver. Entire Agreement. These Terms and policies referenced herein (including our Privacy Policy) are the entire agreement between you and us regarding the Service. Assignment. You may not assign these Terms without our prior written consent; we may assign these Terms.
